Kendelse i forbudssag

Ikke forbud mod brug af ordet FORZA samt ordkombinationerne FORZA FIGHTING GEAR og FORZA SPORTSWEAR

Østre Landsret har den 7. juli 2023 afsagt kendelse om at ophæve et af Sø- og Handelsretten efter anmodning fra Sports Group Denmark A/S og Victor Rackets Ind. Corp. nedlagt forbud mod, at EPC Alternative Source og Forza Fighting Gear BV i Danmark anvender ordet FORZA samt ordkombinationerne FORZA FIGHTING GEAR og FORZA SPORTSWEAR og de dertilhørende figurmærker i forbindelse med salg og markedsføring af nærmere angivne varer og tjenesteydelser.

Landsretten fandt i modsætning til flertallet i Sø- og Handelsretten, at det ikke kunne anses for sandsynliggjort, at EPC Alternative Source og Forza Fighting Gear BV havde foretaget eller agtede at foretage salg, markedsføring mv. rettet mod Danmark og danske forbrugere, som krænkede eller ville krænke Sports Group Denmark A/S og Victor Rackets Ind. Corp.’s varemærkerettigheder eller rettigheder efter markedsføringsloven.
