Sigtede har kæret Holbæk Rets kendelse af 19. februar 2008 (S 60-587/2008), hvorved han i medfør af retsplejelovens § 762, stk. 1, nr. 2 og nr. 3, er blevet varetægtsfængslet til den 18. marts 2008 som sigtet for overtrædelse af straffelovens § 119, stk. 1, jf. § 23, § 181, stk. 1, jf. § 23, § 134a, jf. § 23 og § 136.

Da de i sigtelsens forhold 4 nævnte udtagelser alene går på, at man vil blive ved med at ”demonstrere” , og ikke indeholder nogen kvalificering af eventuelle forb rydelser i forbin-delse med sådanne demonstrationer, kan de ikke anses for omfattet af straffelovens § 136, og da der intet bevis foreligger for at sigtede har haft tilknytning til de i forholdene 1-3 nævnte forbrydelser,
