Hjemvisning af forbudssag vedr. Sandoz A/S’ Dimethyl fumarate ”Hexal

Østre Landsret har den 23. august 2024 afsagt kendelse i et kæremål om midlertidigt forbud og påbud meddelt af Sø- og Handelsretten til Sandoz A/S (Sandoz) angående selskabets markedsføring af lægemidlet af Dimethyl fumarate ”Hexal” .

De midlertidige forbud og påbud var udstedt som følge af en sandsynliggjort krænkelse af en af Biogen International GmbH og Biogen (Denmark) A/S påberåbt markedsføringsbeskyttelse udstedt af EU-Kommissionen for Tecfidera – Dimethyl fumarat.

Ved kendelsen tog landsretten alene stilling til et til forlods behandling udskilt spørgsmål om, hvorvidt den kærede kendelse som påstået af Sandoz skulle ophæves og sagen hjemvises som følge af brud på forhandlingsmaksimen og manglende kontradiktion.

Landsretten tog Sandoz’ påstand om ophævelse og hjemvisning til følge.
