Den 16. juni 2008 har fogedretten afsagt kendelse om nægtelse af tilbagetagelse af bil mrk. Chrysler.

Landsretten afsagde

K e n d e l s e:

Indkærede, tidligere Modpart har for fogedretten forklaret, at bilen er videresolgt til Person ved købekontrakt af 6. december 2007. Da Kærende A/S', tidligere Rekvirent vindikationskrav over for Person er betinget af, at ejendoms– forbeholdet kan gøres gældende i forhold til Indkærede, tidligere Modpart, har Kærende A/S, tidligere Rekvirent en retlig interesse i at få prøvet, hvorvidt kreditaftalelovens betingelser for tilbagetagelse formelt er opfyldt.

På denne baggrund tager landsretten Kærende A/S', tidligere Rekvirent påstand til følge som nedenfor bestemt.
